Terms of Service

Welcome to Powil Pearl Tours & Travel. These Terms govern your use of our services. By using our services, you agree to these Terms.

1. Services Provided

Powil Pearl Tours & Travel is a registered travel and tour company licensed under the Uganda Tourism Act, 2008 and regulated by the Uganda Tourism Board (UTB). Our services include:

• Visa processing for Uganda, Kenya, Zambia, and Tanzania (including Zanzibar)
• Study abroad placement and education guidance
• Travel planning and orientation services
• Settlement support and integration services
• Career counseling and documentation support

All services are provided in accordance with applicable Ugandan law, including the Travel Agents Act and Tour Operators Act where applicable.

2. User Responsibilities

You agree to:

• Provide accurate and complete information
• Submit authentic documents only
• Comply with all applicable laws
• Make payments as agreed
• Cooperate throughout the process

3. Service Limitations & Mandatory Disclosures

3.1 Visa & Admission Decisions

Powil Pearl Tours & Travel acts as a facilitator and agent only. We are expressly not liable for visa refusals, immigration holds, or university rejection decisions made by sovereign governments, embassies, immigration authorities, or academic institutions. No refund of service fees will be made solely on the basis of a visa denial where we have fulfilled our service obligations.

3.2 Travel Insurance (Mandatory Recommendation)

3.3 High-Risk Activities Disclaimer

Some of our destination packages may include or reference activities involving inherent risk, including but not limited to gorilla trekking (Uganda), safari game drives (Kenya, Tanzania), white-water rafting (Uganda), mountain hiking (Zambia, Kenya), and Zanzibar water sports. Clients participate in such activities entirely at their own risk. Powil Pearl Tours & Travel expressly disclaims liability for any injury, death, property loss, or other harm arising from participation in high-risk activities.

3.4 Circumstances Beyond Our Control

We are not responsible for:

• Government processing delays or changes in visa policy
• Embassy or consulate closures
• Political instability, civil unrest, or force majeure events
• Natural disasters or health emergencies (e.g., pandemics)
• External factors beyond our reasonable control

4. Payment Terms

Service Fees

• Consultation: Payment due before service
• Visa Services: 50% upfront, 50% before submission
• University Placement: As agreed in contract

Refund Policy

• Before service commencement: Full refund minus processing fee
• After consultation: Partial refund based on work completed
• After submission: No refund on service fees
• Government fees: Generally non-refundable

5. Privacy and Data

Your privacy is governed by our Privacy Policy. By using our services, you consent to data collection and processing as outlined.

6. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for indirect damages, loss of profits, or delays caused by external factors.

7. Termination

Either party may terminate services with written notice. Fees may be retained based on work completed.

8. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of Uganda, including but not limited to:

• The Uganda Tourism Act, 2008
• The Contract Act, Cap 73 (Uganda)
• The Consumer Protection Guidelines issued by the Uganda National Bureau of Standards

All disputes arising from these Terms shall first be subject to good-faith negotiation. Where negotiation fails, disputes shall be referred to mediation or arbitration under the Arbitration and Conciliation Act, Cap 4 (Uganda), before referral to the courts of Uganda. You retain the right to bring a claim in the courts of Uganda at any time.

9. Changes to Terms

We may modify these Terms at any time. Changes take effect immediately upon posting.
